The Toto Station Play Rules & Conditions of Use

“Customer” means the person, firm or corporation entering the Center who registers and or signs any enrollment documents pertaining to The Toto Station. The customer may be taken by Management as having full authority to sign on in respect of the children under their control or supervision.

“Equipment” means the play equipment and activities located within and around The Toto Station.

“User” means the specific 6 month year old age limit to 10 year old age limit.

“Management” means The Toto Station and its managers and employees.

“Center” means The Toto Station located at 4938 Paseo Padre Parkway, Fremont C 94555.

General Members Etiquette

1. Memberships must be in good standing in order to use the facility. Payments must be current and up to date to use programs and facility.

2. Socks must be worn by all children while on the play floor. Shoes are stored in the cubby holes. (Socks are available for sale in all sizes.)

3. No child is permitted to enter the play area or facility without a valid membership card and a parent or responsible adult bringing them into the center. Parents/Guardians must present the membership access card to confirm the membership, and for tracking drop off and pick up times.

4. Outside food and drinks are not allowed, with the exception of baby food and formula which can only be consumed in the lounge area. Parents may purchase our snacks from the vending machines and consume them in the lounge area or during private events if they have received prior written permission.

5. No gum or other food or drink items allowed in the play area.

6. No personal toys or personal backpacks or handbags allowed in the play areas.

7. No strollers or bikes allowed on the premises and should be parked outside The Toto Station at your own risk. If brought onto the premises, they will be removed and placed outside.

8. Our restrooms have diaper changing tables for the convenience of the mom and me toddler program members. Plastic bags will be provided to mothers to dispose of the soiled diaper in garbage contained outside the premises of The Toto Station. No soiled diapers are to be thrown or placed in any garbage receptacles within out facility. Mothers are required to bring their own supplies of diapers/cleaning material and change of clothing. In the event of an emergency, clean diapers will be available for purchase from out staff at $2.00/diaper.

9. The Toto Station is not responsible for lost or stolen items. All items and personal belongings, backpacks and clothing must be properly labeled.

10. The only parents permitted into the play area are members of the mom and me program during the specific timings of classes. All other parents may wait in the lounge area.

11. Parents are permitted in the play area during prepaid private events such as birthday parties, shows etc. Depending on the package purchased a restricted number of adults will be permitted into the play area. However, there are no shoes permitted in the play area regardless of the event. Only clean socks maybe worn at all times. Socks are available for purchase in case of emergency from the reception desk.

12. Children that are considered disruptive or a hazard, or those who continue to have persistent behavioral issues will be disenrolled from the program without notice. There will be no refunds or prorated fees or tuition applicable under any circumstances.

13. Parents and children may not access or enter the employee designated areas or take any material, books or other forms of instructional material without the written and approved permission of the management of The Toto Station.

14. Late charges and early drop off rates will apply to all cases without exception and are required to be paid at time of pickup or drop off in cash or check without exception.

15. The Toto Station reserves the right to cancel a user’s membership if the management feels that the user(s) is not using the facility in a safe and friendly manner.

16. Discount or other special gift checks and coupons will be honored up to the expiration date only.

17. The Toto Station and management reserves the right at any time and without notice to revise the costs of charges quoted invoiced and advertised.

18. The customer shall indemnify and hold the Management harmless against all claims, actions, suits, demands, costs, expenses, including all legal costs and expenses in any way arising out of the use of the Equipment by the Customer during the period of play whatever caused by negligence of the customer, his servants or agents, or by negligence of any other person whatsoever or arising out of the condition of the Equipment or the use to which it is put.

19. The customer agrees that no footwear or jewelry is to be worn during any class sessions. No sharp objects, toys, food, drinks or any other articles that could cause damage to the equipment or the user are to be used or around the equipment.

20. There is to be no running anywhere in the center, in the class area, playground or the lounge area. No rough play will be permitted.

21. As this is a Play Center catering for many people at its peak times it is essential for the customers to understand there will be instances of accidents like bumps, bruises and sprains. We will not be held responsible for such accidents and you enter the Center at your own risk.

22. The Management of The Toto Station reserves the right to refuse admission or to ask you or your guest/children to leave or terminate your membership, if we reasonably believe that you or your guest is in breach of any of our conditions..

23. We will endeavour to provide the best possible service to members and to deliver the commitments made as part of our strategy. However, subject to written notification, the management team reserves the right to amend the Membership Terms & Conditions, Programs and Prices in light of changing circumstances and/or to ensure the health and safety of Members.

24. Your Membership is personal to your child, it cannot be assigned or transferred to another person. If you lend your Membership card to another person we will terminate your Membership.

25. If you forget to bring your valid Membership card, we reserve the right to refuse admission or entry if you cannot provide alternative satisfactory proof of identity. We also reserve the right to refuse admission if you repeatedly fail to bring your Membership card. After the third time without your card during your membership period you will be charged the guest fee rate to gain entry.

26. In the event of loss or theft, a replacement membership card will be required at a minimum fee of $10.00.

27. Once paid, Membership fees, tuition and payments are non refundable under any circumstances. There are no prorated fees for missed or cancelled classes for any reason whatsoever. Once a class is paid for, there will be no refunds or transfers or carry over for payment and tuition.

28. You must not abuse the equipment or facilities of the center. Any willful, negligent or deliberate damage to The Toto Station property by yourself, your child or your guest(s) must be paid for.

29. You may not behave in a disorderly, violent or rude manner or in a manner, which causes or is likely to cause offence or distress to other Members, Guests or staff.

30. You may not bring alcoholic or intoxicating liquor, narcotics, or other mood altering substances, or consume them at, the Toto Station facility.

Disclaimer
1. It is the member's responsibility to follow Health & Safety notices and the instructions of Staff.
2. The Toto Station is unable to accept liability for any loss, damage to or theft of your personal property or that of your guests, whilst on the premises.

BIRTHDAY PARTIES AND PRIVATE CELEBRATIONS

1. A $100.00 deposit for all events is required when the reservation is made and must be paid at the time of the reservation. Any outstanding balance must be paid 7 days prior to the event by cash or check. Depending on the size of the party, a minimum non-refundable cleaning fee of $50.00 will apply in all cases. A refundable $100.00 deposit will be collected at the time of reservation, and applied to any damage or destruction of property or the facility.

2. Once an event has been reserved and the $100.00 deposit to hold the date has been paid, this becomes non-refundable and will not be refunded if cancelled.

3. The customer acknowledges that Management has ultimate control over the use of the Equipment. The customer shall not permit any person who is not over the legal age to supervise their children – the legal age is 18 years old.

4. During any private events or celebrations, the customer agrees to provide adequate supervision for the children or party guests, accept full responsibility and liability for their own guests, and ensure that any user of the equipment shall comply with all the relevant statutes, regulations and by-laws that apply to The Toto Station and the equipment.

5. No latex balloons, only Mylar balloons are permitted.

6. Entertainment and vendors invited to perform at event can only be contracted through The Toto Station and /or written approval provided by the Management of The Toto Station for any accessibility into the center. Unapproved vendors will not be invited.

PRIVACY POLICY

The information you provide will not be shared with any other business but the owners of The Toto Station and their associated businesses. The information depending on statutes may be provided to insurance companies or associated legal professionals to the extent that the State or Territorial Laws permit.

LIMITATION OF LIABILITY

1. All conditions, terms and warranties, which are not expressly contained in this agreement, are hereby excluded.
2. Any warranty, condition, description or representation, whether expressed or implied, as to the description, state, quality, merchantability of the Equipment for the purpose for which it is hired is herby excluded.
3. The management shall not be responsible or liable to the customer, whether on grounds of breach of contract, contractual duty or negligence, for any loss or damage that the customer may directly or indirectly sustain or suffer arising from defects in or miscalculations, breakdown or failure of performance of the Equipment, and the customer hereby exonerates and releases the Management from all claims and demands in respect thereof.

SEVERANCE

In the event of any part of the conditions of use becoming void or unenforceable whether due to the provision of any statue or otherwise, then that part shall be severed from these conditions, to the extent that all parts that shall not be or become void or unenforceable shall remain in full force and effect and be unaffected by any such severance.

Other

We reserve the right to:
1. Vary, revoke or add to these Rules.
2. Adjust the availability of certain facilities on a temporary basis for the general purpose of cleaning, decorating, essential repairs, maintenance of equipment, special functions (exams) & holidays.
3. Change the tuition rates and other rates applicable to other services offered without notice.
